What is Katarungang Pambarangay?

The Katarungang Pambarangay (Barangay Justice System) is a community-based dispute resolution mechanism mandated by the Local Government Code. It aims to resolve conflicts amicably at the barangay level, decongesting courts and preserving community harmony. For many disputes, you are required to go through barangay mediation before filing a case in court.

The Lupong Tagapamayapa

Each barangay has a Lupong Tagapamayapa composed of:

  • Punong Barangay (Chairman)— Conducts initial mediation
  • 10-20 Lupon Members— Selected residents known for integrity
  • Pangkat ng Tagapagkasundo— 3-member conciliation panel if mediation fails

The Process

File a Complaint at the Barangay

Submit a written complaint to the Lupong Tagapamayapa (Barangay Justice) office. Include details of the dispute and the other party's information.

Mediation by Punong Barangay

The Barangay Captain will first attempt to mediate between you and the other party. This happens within 15 days of filing.

Pangkat Conciliation (If Needed)

If mediation fails, a 3-member panel (Pangkat ng Tagapagkasundo) will be formed to continue conciliation efforts.

Settlement or Arbitration

If both parties agree, they sign an Amicable Settlement. Or they can agree to let the Lupon decide (Arbitration Award).

Certificate to File Action

If no settlement is reached after all efforts, the barangay issues a Certificate to File Action, allowing you to proceed to court.

Possible Outcomes

Amicable Settlement

Both parties agree on a solution and sign an agreement. This has the force of a court judgment.

Arbitration Award

Both parties agree to let the Lupon decide. The decision is binding like a court judgment.

Certificate to File Action

No settlement reached. You can now file the case in court.

Tips for Successful Mediation

  • Come with an open mind and willingness to compromise
  • Bring all relevant documents and evidence
  • Stay calm and respectful during proceedings
  • Focus on solutions, not blame
  • Attend all scheduled hearings — failure to appear may result in dismissal

Legal Effect of Settlements

An Amicable Settlement or Arbitration Award has the force of a final court judgment. If the other party doesn't comply, you can file for execution within 6 months, or file a case in court after 6 months.

  • Neighbor disputes (noise, boundaries, easements)
  • Unpaid debts under ₱400,000
  • Minor physical injuries
  • Verbal abuse or threats
  • Property damage
  • Contract disputes between individuals
  • Family matters (not covered by family courts)
  • Landlord-tenant issues

Exceptions (Go to Court)

  • Cases where one party is the government
  • Offenses punishable by more than 1 year imprisonment
  • Cases involving real property in different cities
  • Disputes where parties live in different cities/municipalities
  • Cases requiring urgent legal action
  • Offenses where there is no private offended party
